Toxic Exposure

Toxic exposure can come in many forms, from harmful chemicals to naturally occurring substances like mold. Toxins can be inhaled, swallowed, or absorbed by body contact. Some toxins have a smell or color, while others are odorless and invisible. Toxic exposure can happen at work, home, or nearly any other environment. Toxins can affect any of your organs including the brain. Some effects grow worse with greater exposure time, eventually causing permanent disability and even death. Sadly, many people who have been exposed to toxic chemicals do not know what is causing their symptoms.

Common toxic agents include:

  • Cleaning agents
  • Paints, solvents, and glues
  • Caustics
  • Hydrocarbons
  • Bleach
  • Herbicides and pesticides
  • Mold
  • Asbestos
  • Lead
  • Arsenic
  • Foodborne microorganisms
  • Chemicals leaching into water from pipes

The "toxic level" of a substance is often defined by how rats react to an exposure over time, not by the number or severity of human injuries from exposure. Furthermore, 75,000 substances registered with the EPA that may cause severe reactions in humans have not been tested in any way.

Complicating efforts to help is the fact that not everyone is sensitive to toxins to the same degree. For example, experts have never been able to agree on the level of toxic molds that must be present in an environment for there to be a danger to humans. Many people become ill in moldy environments, while others show no symptoms.

Any person who is injured as a result of toxic exposure, whether an adult or a minor, is entitled to bring a toxic tort claim against the person or company at fault. Frequently, because toxic exposure cases are difficult to prove, a large group of plaintiffs will band together to bring the case. If someone dies due to a toxic exposure, close family members can bring a lawsuit.

There are any number of potential defendants who can be held liable in toxic exposure cases depending upon the type of toxin and the type of exposure. You can sue anybody who wrongfully caused your toxic exposure, which might include chemical manufacturers, landowners, home- or apartment-owners, owners or operators of a plant or refinery, or any person or entity that wrongfully sends toxins into the earth, ground, or water.
